Bicycle Laws in Montana

As a bicyclist in Helena, you have both rights and responsibilities on the road. These are outlined in Montana’s bicycle traffic laws. When riding on roadways, bicyclists traveling below the speed of traffic should stay in the far right traffic lane. You may use other lanes when overtaking and passing a slower car, preparing for a left turn, or when the far right lane is a right-turn lane. On roads with at least two lanes in each direction, bicyclists may ride two abreast in one lane as long as they do not impede the flow of traffic.

Bicyclists must always have at least one hand on the handlebars and are legally barred from carrying items that prevent them from doing so. When riding at night, bicyclists must have a white light lamp on the front, a red light or reflector on the rear of the bike, and reflective material visible from both the left and the right. For those biking within a city, Montana law allows for bikes to use crosswalks, but the bicyclist must yield to pedestrians and give an audible signal if overtaking a pedestrian in a crosswalk.

Common Bicycle Accident Injuries

Bicyclists are at grave risk of catastrophic injuries in accidents including death, since they have so little protection when hit by a car or truck. The most protection a bicyclist is likely to have is a helmet. Some of the most common bicycle accident injuries include:

  • Head injuries: A surprising amount of bicyclists do not wear helmets, despite knowing the catastrophic and fatal outcomes that often come with traumatic brain injuries. Even with a helmet a hard enough hit to the head can cause a traumatic brain injury. TBIs range from mild to severe, with severe injuries often resulting in permanent loss of physical or mental function.
  • Spinal cord injuries: When a bicyclist is thrown from their bike or struck hard enough by a car, their spinal cord may be completely or incompletely severed. This leads to a loss of physical function below the point of impact. While bicyclists may recover from incomplete spinal cord injuries, complete injuries lead to permanent paralysis.
  • Broken bones: Broken bones are among the most common injuries suffered by bicyclists. Broken arms, legs, and ribs are common. If a bicyclist uses foot clips to stay on their bike, they may also suffer damage to their ankles and feet.
  • Facial injuries: The impact of the road may cause disfiguring facial injuries for riders. These injuries include abrasions, lacerations, damage to the eyes, broken or dislocated jaw bones, and dental injuries.

Types of Compensation

If you have evidence that someone else was responsible for your Helena bicycle accident, you may be able to pursue compensation with a personal injury claim. In many cases, drivers are responsible for bicycle accidents. They may fail to check for bikers before turning, change lanes without checking their blind spot, fail to yield to bicyclists, or follow too closely. A successful claim may result in compensation for:

  • Past and future medical expenses, including medical bills, transportation, over-the-counter supplies, and adaptive equipment
  • Lost wages
  • Property damage
  • Pain and suffering
  • Disability and disfigurement
  • Loss of quality of life
  • Wrongful death

Documenting your losses as thoroughly as possible can help you fight for every dollar you deserve.
