Different Types of Traumatic Brain Injuries and Spinal Injuries
Your legal options depend largely on the severity of your injury and your prognosis. Traumatic brain injuries are generally categorized as mild, moderate, or severe. Concussions are the most common form of mild traumatic brain injury, and many resolve with time and rest. People with moderate and severe traumatic brain injuries may be left with permanent deficits and require costly lifelong care.
Traumatic brain injuries can also be categorized by how they occur. Blunt, penetrating, and blast traumatic brain injuries all have different risks. Blunt TBIs cause the brain to strike the inside of the skull. For example, a severe car accident that causes you to jerk back and forth violently can cause a blunt TBI, sometimes referred to as a coup-countercoup injury, causing injury to both sides of the brain. A blunt traumatic brain injury will show up on an MRI or a CT scan if there is an internal brain bleed or hemorrhage.
However, many times a blunt traumatic brain injury does not show up on an MRI or a CT scan because the scans are not sensitive enough to see the microscopic damage to the microtears in the brain tissue. In this case, there are numerous diagnostic tests that can be done to help document the full extent of the brain injury, but that medical care is costly.
The other type of brain injury is a penetrating traumatic brain injury. This type of TBI happens when something pierces the brain. This includes injuries from gunshots and stab wounds. Blast TBIs are generally the result of bombings.
Spinal injuries are often classified by where on the spine they occur. The higher on the spine an injury occurs, the more profoundly the victim is affected. Injuries may occur at the cervical, thoracic, lumbar, or sacral level. Going one step further, spinal cord injuries are also categorized by their severity. A complete spinal cord injury is one that completely severs the spinal cord, resulting in a complete loss of sensation and control below the injury. An incomplete spinal injury, on the other hand, leaves the spinal cord partially intact. There is still some loss of function, but recovery is possible.
Compensation for Traumatic Brain Injuries and Spinal Injuries
Traumatic brain injuries and spinal cord injuries are among the worst possible outcomes of a truck accident, car accident, slip and fall, or other type of accident. They have the potential to affect victims for the rest of their lives. A traumatic brain injury can lead to permanent loss of physical function, emotional control, and mental function. In the more severe cases, victims can require around-the-clock care, as well as physical therapy, occupational therapy, and pain management. Those who suffer spinal cord injuries often have the same outcomes; those who regain the ability to walk may require months to years of physical and occupational therapy to do so.
When such serious losses follow an injury, victims are often owed compensation. Personal injury victims in Montana may receive compensation for medical bills, lost wages, property damage, and other easily calculated losses. However, you could also be entitled to compensation for your non-financial losses. A fair settlement would include money for your pain and suffering, loss of quality of life, disability, and disfigurement.
Much depends on how much evidence you have and how profoundly your life is changed by your injury. That’s where our team can help.
